If i quick claim deed an investment house to my son how fast can he resell it? We have a buyer and need to turn it fast so he can buy a house with the cash. There is no mortgage on the property and will sell for $30.000. Does he have to register the deed and wait or can he resell it with another quick claim deed? Also if it is a gift he should not have to show it as an income or should we make a loan contract with him to pay us back?

Should I sell an income producing property to pay off primary home?

I’m trying to retire early and do what I really like – be an artist full time. I’m 39 and was lucky enough to buy a property in Austin near campus that generates $4500 a month for me. Being that it is Austin, I’d likely be crazy to ever sell, I could live off that income the rest of my life and it will grow faster than inflation. Of course I do have high taxes and a note of $359K but still produces nice income. Because both me and my wife both started our own businesses in the beginning of the recession, we have not done as well as we would have liked. We bought a home on the coast of FL for only $220,000 and have business debt of $40K. My options I’m considering are: 1) Keep the duplex in Austin, counting on paying off the note “someday” and having more than enough income for life but I’ll need to go back to corporate America today for a job to get out of struggle mode. 2) Sell this incredible property with income and in a top Austin location that will no doubt be worth over $1mm in a few years, pay off debt and primary home completely and live as an artist today, foregoing future income for retirement from the rental. Assuming I can paint for life but that would be my only income likely when I’m older but with almost no expenses for life, it should work. Of course there are tons of assumptions on both sides but the main issue is that if I look at life today, I’m not sure the note on both homes will ever be paid off and it is keeping me from focusing on my art and I dread returning to corporate America. (Oh, the home should sell today for $600-700K).

I would like to buy a (private) property that is a reposession, marketed by an estate agent. I assume the seller in this case is the bank? Would they accept a lower offer than a private seller would, as all they need to recover is the loan plus interest owed plus admin. costs? What is the cost of a repossession to a lender? Would they wait around for the highest offer or would they be happy with a let’s say 90% of the asking price? Are they interested in making a profit or all they want is to cover their costs? Home inspection, no power to property, buying dispute?

Recently made an offer on a home. It is in great condition, at least to the naked eye. Seller’s accepted our offer and we are in closing. Seller requested a fast inspection of the property. When we looked at the property, we noticed that the power to the property had been shut off. This was a divorce sale and neither party would pay the utilities. Anyhow, we requested through our agent that the utilities MUSTbe active for a proper inspection to be done. As noted by our inspector, the inspection would only be half good without power. The selling agent assured us the power would be on.

Well you guessed it. Inspector shows up and there is NO POWER! Selling agent states we still must follow through on the deal since we never put it in writing. I called BS as no inspection is an inspection without power???? It’s like asking someone to test drive a car with no tires. Can I legally back out of the deal?

Okay I have a complicated situation that I would love help with. I co- own a home with a long time (15years) significant other. The relationship is at the end and I have asked him to leave. He has made it perfectly clear that he is not going to leave and is making my daily life difficult. So I have made the decision to leave. Well here is the kicker, I paid and always have since purchasing the home 100% of the mortgage. His monthly pay does not even cover the principal and interest payment of the house. Once I leave (in the next couple of months) I will not be making the payments. Should I let the house go into foreclosure? I was thinking of maybe calling the lender and letting them know the situation and see if they can sell the property and fast forward a foreclosure. Just a little background-The property is relatively new and is worth about or maybe a little less than what I owe. Any advice would be great!

My husband owns 1/2 and his brother and sister-in-law own 1/2 a house together (their dad’s house – inherited). The problem is my husband and his brother can’t agree on a selling price, and his brother refused my husband’s offer to buy his half out. His brother wants to sell the house fast for a low price (yet refused my husband’s offer of what he would end up with, if he got the price he wants minus the realtor’s cut) and my husband (if he isn’t allowed to buy his brother out for what we can afford) would like to sell it for a higher price, even if that means we have to hold onto it longer. The price my husband set it at is still considerably less than the value it was appraised at before property values fell. His brother chose the realtor, who hasn’t been officially hired yet. The realtor feels that my husband’s price is the most they can get for it, but what he doesn’t know is that my husband will refuse any offer lower than that.
His brother is a controller and wants to make all the decisions, yet my husband is the executor.
The brother is the one who chose the realtor and doesn’t want my husband to get a different one involved.
It doesn’t make sense that his brother wants to sell the house fast and cheap, but yet would not even entertain the idea of selling his half to my husband. The price my husband offered was in keeping with the price his brother would get if it sold for the price he wants. Any money over that would go to pay the realtor’s commission.
I wish there was some King Solomon who could make a decision that would be right and fair. His brother is all about the money and my husband is all about hanging onto something that is important to him.
