I have 1 year lease on the property , my land lord want me to vacate Please help?

I have 1 year lease on the property .My land lord gave me written notice to vacate in 30 days reason being he wants to move in to the property .I replied back to him saying that ,Fair housing evaluated my lease and confirmed that I don’t need to vacate .

Now immediately he want me to vacate because I am in violation of Section 8 of the rental agreement which appears on page 2 of the agreement and which is blank on the copy that he gave me when I signed the lease. We never agreed on the number of people staying in the unit , any way he claims that agreement has only 2 people .
The house 2 bedroom 1400 square foot. But my wife delivered a baby 3 weeks back and my baby is not in the lease. I have a visiting guest (has us visiting visa) will be spending some time with baby and will be leaving the country next month .Lease does not say any thing about guests…

    He can’t kick you out without a court order. Tell him to come back with the police.

    Keep paying your rent (keep checks/receipts for goodness sake) and start looking to find a new place.

    Make him take you to court to evict you. Screw him. If he shows up and gets violent call the cops immediately.

    Hopefully by the time it gets to court you will have found a new place. For every door that closes, another one opens.

    I really don’t know how rental leases work in the US but in the UK he would need to issue a Notice of Seeking Possession and then apply to the the court.

    I would try to speak to someone with some legal experience. Do you have any advice centres nearby.

    Regardless of the legal postion, I would suggest you stay put until you know where you stand legally. I think he is pushing his luck by trying to enforce a blank section as he could, in theory, put anything in there! Stand your ground and I would advise that you don’t leave the property unattended until it is resolved and never open the door to someone you don’t know.

    Check with your State Law as to what is legal and not legal. I know in the State of VA there can be no more that 2 people per bedroom ( 2 bedrooms = max 4 people) but your state could be different. Try googling Renters Rights for your particular state.
