Is it legal to lease a house you own and still live in a walled off portion of the same house? LEASE?

lease house

It seems wrong to me. My next door neighbor leased 90 % of their house out and let his son and girlfriend live in an area that sealed the door off to the rest of the house, the remaining 10%. Then he cut in a door on the side of the house. My side of course.

As long as they followed the building codes and had the proper permits and as long as there is no city ordinance against this (usually it starts at 4 non-related people per home) then he is legal.

Why do you care what your neighbor does with his house? It is really none of your business.

    I hate busy bodies!

But to answer the question – as long as they got permits for the construction and followed all building codes. Then it is perfectly legal. People rent out just a room in their house all the time.

Actually, what you may have here is an illegal duplex….I see people pull this kind of stuff in my neighborhood all the time because they think no one is watching. It doesn’t matter if the renters are related or not, you can not convert your house into a duplex without filing an application with Planning & Zoning…it’s that simple.

Call your local Planning & Zoning department, and let them know that the neighbor did an illegal duplex conversion. They’ll make him tear it out OR, if duplexes are allowed in your subdivision, will make him file an application & a set of blueprints that meet the city’s duplex standards which he will have to adhere to. The standards are pretty high, and my guess is that the guy will simply knock down the wall.

It probably violates building codes and zoning regulations. A zoning variance would have required a public hearing that you would have to be notified of.
