what r the legal rights of house owner & tenant when lease agreement is over ?

A house leased for 1 lac ( without rent) for 2 yrs. Lease ended but both the parties r silent and house occupied by tenant and the lease amount is with the owner. Now can both the parties can simultaneously exchange the things or the Tenant has any speical rights? Tennant demand cash but owner want to pay by a/c payee cheq. Advice please

    this questions kinda rough…….lease ended, automatically goes to month-to-month same rent…..unless the owner wants to raise the rent, in which case he has to give a 30 day notice stating how much, and when it starts…..they can enter into a new lease…….the owners in the drivers seat, and has to make the 1st move, if he wants a lease, or wants to raise the rent………
    if he just wants to sit on his thumb, the rent stays the same, and the tenant is month-to-month…………….

    I am not following all of this. But, it is the landlord who determines how the rent is paid, if they care. If he wants a check he gets a check.

    hello curious

    your question is already answered. if tenant need cash you can pay by simultaneously getting the key. if he need time for vacating you better pay by account payee cheque with an endorsement in the original lease agreement.

    there is no special rights for tenant.
