Am I protected from litigation if I use a property management company to rent my house?

If I use a property management company to rent my house out and the tenant decides to sue, is s/he going to sue the property management company or me? The lease would be between the tenant and the property management company. Please provide any research resources in your answer.

    It depends on what they are suing for.

    Typically the sue the landlord, which is the management company, but you may have to pay damages, as they are working on your behalf.

    However, as I said, it depends on the suit, the landlord may need to send it to their insurance company.

    They only way you would be protected from a suite from a renter would be if your contract with the management company would contain a “4 corner” hold harmless agreement whereby they would hold you harmless and defend you in any suite arising out of their management of your property. There will always be obligations for you to comply with any and all recommendations regarding maintenance and safe upkeep of premises, which for a price can be assumed by the management company. Bottom line; you can’t protect yourself from all suites but you can substantially reduce or eliminate all but the most frivolous suites. Don’t forget. One can be sued for anything, anytime for any reason weather valid or not.

    Don’t worry, if they decide to sue, they’ll sue everone in sight. Just have good insurance and a good manager.
