Is it legal for a landlord to sell the property and force the tenants to move out before the lease ends?

sell my property

Hi all =)
Any input or advice would be much appreciated. My roomates and I are renting a condo in the Los Angeles area. My landlord has just informed us (orally) that he intends to sell the property. We are on a year-long lease and only 7 months in. The contract is valid until August 2007. He told us that he is giving us a 60-day notice starting this Sunday to move-out. Isn’t there a law requiring him to give us a reasonable amount of time to move out or to honor the contract until its full term? Is a 60-day notice considered reasonable?

To begin with to be leagal it has to be in writing. Depending on the laws where you live normaly they have to give you 90 days.

I’m no legal expert, but it doesn’t sound legal since you have a written agreement I think he should have to pay all of your related moving expenses.

I would definitely call an attorney. The purpose of a lease is to protect you and the landlord. My guess is that he has suddenly decided to sell and he’s running a bluff to see if you will move.

I simply would not take him seriously until he serves me with something in writing to give to your attorney so that he will be forced to pay all your moving expense.

    Good Luck

The first thing you should do is read your lease agreement. There should be something in it to cover just such a situation.

A property owner can sell his property anytime he wants to. That is why there is usually such a clause in the lease.

It is legal for the landlord to sell the property before the lease runs out. The new owner assumes the duties and responsibilities of the lessor (landlord). In fact, rental property that is fully leased is more valuable than property with vacancies.

You should read all fo the fine print in your lease. I cannot imagine that there would be a clause that would allow your landlord to evict you in the event the property is sold. After all, the whole idea of a lease is to ensure that a piece of property is leased under contract for a specific period of time.

If there is no language granting hin the right to evict you in the event the property is sold, the landlord has no right to ask you to leave before the term of the lease is over.

    Good luck with your situation.
