question about selling property in a divorce?

My husband informed me today that he has someone coming to look at our house to buy it. I knew we both agreed to sell it in the future (after he finnished some repairs) but I had no idea he was going to do so this fast. He flat out told me that he is going to take the first offer, no matter how much it is, as long as it equal to or high than what we own. The thing is, it’s worth two times what we owe, and i dont want to be ripped off. Since my name is on the mortgage too, he cant sell it without my approval or agreeance, can he?

    He can’t sell the house without you signing paperwork…..don’t agree to this crap. Just refuse to sign anything for less than whatever you feel is justified. I am assuming he has not hired a real estate agent since I’m sure if the agent knew you would not be signing to sell for less then a certain price, he wouldn’t be bringing people there.

    True, he needs your signature. I just cant understand why he would just want to sll it for what you ow. Doesnt mke any sense if he could get more. Just be ready for the backlash this will probably cause on your marriage, but if you dont agree then dont sign

    Sounds like u need to get ur attorney involved. He cant sell the house without ur signature. You bought it together u sell it together. If he doesnt agree with ur outlook on selling of ur home then u need to follow thru with legal action.

    O.K. again, let’s start with facts that you failed to provide. First, you said your name was on the mortgage. o.k. is it also on the DEED?

    If the answer to the above is no, then he has every right to sell HIS property. A mortgage is a financial instrument which does not convey ownership. Only the deed can do that.

    Also, while your title suggested divorce, no where in your post have you indicated whether a divorce action had begun. So, have either of you filed for divorce?

    and when was the home refinanced / purchased to place your name on the mortgage?
